Park regulations Hofparken
Along with the general conditions that apply to the agreement between the landlord and tenant, the park regulations form one whole. Proper compliance with park regulations ensures the safety and enjoyment of our guests. For this reason, we would like to ask you for your cooperation and understanding.
All terms used in the park regulations are consistent with the definitions provided in the General Conditions.
Article 1. LIABILITY
- Lessor shall not be liable for damage and/or bodily injury to property and/or persons, residing at the Park, except for damage and/or injury intentionally caused by lessor.
Article 2. OPERATION OF PARK REGULATIONS
- Each tenant and/or user is obliged to impose the provisions of these Park Rules and Regulations on their family members, guests and visitors at the Park. Tenant is responsible for these persons' compliance with park regulations. All obligations imposed on a tenant in these park regulations also apply, to the extent possible, to a family member, a guest or visitor of a tenant, as well as to a user of recreational property. If violated, access to the park may be denied to the person in question by lessor.
- The tenant and/or user is fully and irrevocably liable for all damage caused by his or her actions to other people's property and/or the general facilities.
- The tenant and/or user, their family members and their guests are expected to do and/or refrain from doing all those things that are befitting a good holidaymaker.
Article 3 CONDITIONS
- General:
- Each tenant and/or user is bound to respect the privacy and peace of the other owners, tenants, users, and visitors to the park.
- Each tenant and/or user is obliged to use the land and the recreation property in accordance with the destination indicated above.
- Tenant/users are not permitted to behave in such a way as to disrupt public order, or of which behavior it is reasonable to assume that public order may be disrupted by such behavior. Public drunkenness, drug use (including growing, cultivating and/or producing narcotics), prostitution, the operation of any business activity (legal or not), or trading (illegal or not) is not allowed.
- Nude recreation is not permitted.
- It is not allowed to offer goods (including drinks or food) for sale in the park, or distribute propaganda for any purpose or advertise any product.
- It is not permitted to enter (the lot of) another recreational property (except with the permission of the respective rights holder) or the greenery of the park.
- Swimming is permitted in water bodies designated by the Lessor, unless local
regulations do not allow this (temporarily) and is done at your own risk at all times. Diving or jumping from jetties/patios/etc. is prohibited. - Fishing is permitted only in the pond/water feature designated by Lessor. Fish must be released at all times. Fishing is not allowed if local ordinances do not allow it, or do not allow it temporarily. However, the tenant and/or user of a recreational property is responsible for obtaining the necessary permit for this purpose. The tenant and/or user must strictly comply with the accompanying conditions, any regulations or other provisions, however designated.
- It is not permitted to use radio, television, or other audiovisual equipment or play musical instruments outside a recreational property. The sound of audiovisual and/or sound equipment must not be audible outside the private recreation property.
- Acting in a way between recreation objects, play soccer or any other game in such a way that it may cause damage is not allowed.
- Pollution(s) and/or damage(s) committed by minor(s) will be recovered from their parent(s) and/or guardian(s).
- Lessor cannot be held liable for larceny of property(s) belonging to the tenant and/or user of recreational property and/or visitors to the park
Vehicles/vessels
- Driving cars at the park should be kept to a minimum.
- Visitors' cars are to be parked on the landlord's designated lot to the extent that space is available for this purpose.
- Cars and other vehicles are not allowed to park at the park other than in the designated parking areas. Intended for each for individual use
- Per recreation object, up to one passenger car may be parked in the designated space. If there is sufficient space for a second parking space on the lot of the recreational property, the parking of a second passenger car is allowed for a fee.
- It is not permitted to park trailers, campers, touring caravans, etc. at the Park (whether on private property or not). Objects parked or stored on the (parking) area (such as caravans, etc.) without Lessor's permission will be removed without warning at the expense of the Tenant and/or the user or the person who parked or parked the object.
- Washing cars and other vehicles on or near the recreational property is never allowed.
- It is not allowed at the Park (including the recreational property), including the parking lots, to perform maintenance on cars, motorcycles, and vessels, such as oil changes and other repairs.
- A speed limit of ten kilometers per hour applies throughout the grounds. Upon the second finding of violation of this rule, the park's lessor has the right to have the vehicle in question placed outside the park, and/or to have it banned.
- No truck or other large vehicle is allowed to enter the park.
- It is forbidden to enter the premises with motor vehicles on the non-paved and on the paved roads indicated by prohibition signs. Only if strictly necessary may lessor waive this prohibition.
- Cycling on the grass is prohibited. This prohibition does not apply to those, who by decision of Lessor of the park have been exempted from this.
- Exterior/Yard
- Tenant and/or user must keep the recreation property lot and recreation park free of (litter) at all times.
- It is not permitted to affix signs, posters, and the like on the lots and/or on or to or visible on the recreation object.
- Obstructions, including tents, must be removed before sunset. Party tents are never allowed.
- Blankets and other bedding may only be aired from sunrise to noon.
- The display of flags, posters, or other items expressing any particular political or ecclesiastical cause is not permitted.
- It is not permitted to withdraw water from the recreational property/land and water features belonging to the park (or have it withdrawn);
- Barbecuing is permitted, provided that no warnings and/or prohibitions are issued by competent authorities and proper equipment is used. In addition, necessary precautions should be taken regarding fire hazards. There must also be no nuisance (smoke, smell, noise, and so on) to other people present at the park. Extreme caution should be taken with fire. Wastes (combustion residues) generated from barbecuing shall not be deposited on or in the soil.
- The lighting of open fires, fireworks, and light shows are strictly prohibited at the park. It is not permitted to keep one or more all-burner(s), wood stove(s), fireplace(s), oil stove(s), and the like in and around the recreation property. Flammable materials, accellerants, and fire-hazardous substances may not be present in and near the Recreation Object.
- At all times, the regulations of the fire department and/or similar agencies in effect at any time must be complied with.
Emergencies
- In an emergency (for example, if ambulance assistance is needed), Lessor may grant permission to ignore the prohibition signs.
- Tenant and/or user must ensure that all access roads to the park and to the Recreational Objects remain free of obstacles, to provide emergency services free passage at all times.
- In any situation of mischief or suspected calamity that could cause damage to persons/animals, the recreational property and/or the Park, Lessor may gain access to the recreational property and/or the recreational property.
- The tenant and/or user of a recreational object must behave during his/her stay at the Park, both on and in the water, as well as on the shore, in such a way that they do not endanger themselves or any third parties, or run an unnecessary risk of endangering themselves or any third parties and/or causing damage to their own property and/or the property of third parties and/or the Park. The Renter and/or User is obliged to take the necessary precautions in this regard.
Article 5 USE OF GAS AND ELECTRICITY
- For cooking and heating purposes, only the existing piping network of gas may be used. For fire safety and environmental reasons, burning coal, wood, oil, and the like is strictly prohibited. Open fires both inside and outside the Recreation Property are prohibited.
Article 6 PETS
A maximum of two (2) dogs are allowed under condition(s) and for a fee. Dogs are not allowed on the Park unaccompanied, must be leashed at all times and are also not allowed to swim in the ponds.
Dog feces must be cleaned up by the Tenant and/or User. Upon violation of this Article, Lessor shall notify Tenant and/or User in writing that the animal will no longer be allowed at the Park.
Article 7 LIMITING NOISE NUISANCE
The use of a motor mower and other (motorized) noise-causing gardening equipment is not allowed before 10:00 a.m. and after 8:00 p.m. The aforementioned use is completely prohibited on Sundays and holidays. Lessor is entitled to specify the times at which a motor mower can be used. Between 11:00 p.m. and 7:00 a.m., the park must be quiet so residents can sleep. It is also prohibited to use radio, television, or other audiovisual equipment or play musical instruments outside a Recreation Object. The sound of audiovisual and/or sound equipment must not be audible (including between 10:00 a.m. and 8:00 p.m.) outside one's own Recreation Object. In case of violation of this provision, Article 9.5 of the General Terms and Conditions shall apply.
Article 8 DRYING OF LAUNDRY
No drying of laundry is allowed from Saturday afternoon at 1:00 p.m. until the following Monday morning at 8:00 a.m. Clothes lines are not allowed, but a drying rack or clothesline is allowed, which must be cleaned up immediately after use. Version March 2021 10/11
Article 9 HOUSEHOLD/YARD WASTE
Lessor may establish rules regarding the storage, collection, and disposal of household waste, paper, yard, plastic, and residual waste in the broadest sense. Without further regulation in this regard, household, yard, glass, paper, plastic, and residual waste should be deposited in the designated (compactor) container.
Article 10 POLLUTION
Each Tenant and/or User shall refrain from activities that cause any pollution in the Park to soil, surface water, groundwater, groundwater bed, encroachments, pond, water features, and/or shoring, among other things. Discharging anything into pond and/or water bodies as well as polluting surface water is strictly prohibited. Caused polution should be reported immediately to the appropriate authorities. Furthermore, the Tenant and/or User of a Recreational Object shall ensure that the Recreational Object remains in an environmentally hygienic condition. If, through the Tenant's and/or User's actions or omissions, a nuisance caused by vermin, for example, arises, the Tenant and/or User shall be liable to the Lessor in this regard for all damages resulting therefrom. If the Tenant and/or User fails to comply with a written demand by Lessor to undo the nuisance in question within a reasonable period of time, Lessor shall be entitled, at the expense of such negligent Tenant and/or User, to do whatever is reasonably necessary to end such nuisance. A violation of this article is subject to a penalty of fifty thousand euros (€50,000.00) per violation, immediately payable and not subject to set-off, without judicial intervention. This Penalty shall be payable by the mere fact of violation and without any notice of default being required.
Article 11 DENIAL OF THE USE OF GENERAL FACILITIES
- Lessor may deny access to the Park to Lessees and/or Users who:
- fail or violate the provisions of the General Conditions, these Park Rules, or Landlord's decisions;
- are guilty of improper conduct toward the other Owners, Tenants and/or Users, Lessor and/or employees;
- fail to fulfill their financial obligations to the Lessor.
- If one or more of the behaviors referred to in the previous paragraph, after being pointed out by the Lessor, are committed or continued again, the Lessor may decide to deny the use of the Park and the general facilities (which expressly includes the roads, paths and (infrastructural) facilities). Lessor may also decide to disconnect gas, water and electricity, supply of television signals, and/or IT facilities in that case.
Article 17 OPERATION
Tenant and/or User is aware and will tolerate work being performed on the Park for the purpose of development and/or maintenance of the Park. Lessor will attempt to minimize nuisance as much as possible.
Article 19 LIABILITY
The Tenant and/or User shall at all times remain responsible for fulfilling all obligations arising from the above.
Article 20 FINAL PROVISIONS
- Notwithstanding the provisions of these Park Rules, each Tenant and/or User shall be required to comply with all governmental regulations required by law. Version March 2021 11/11
- Lessor may grant written exemption from prohibitions established in these Park Rules for a specified period of time under conditions according to their discretion.
- Lessor is authorized—in consultation with the relevant Tenant and/or User of a Recreational Object—to deviate from these Park Regulations in individual cases. None of the other Tenants/Users can derive any rights from this waiver in that case.
- Failure to comply with one or more of the provisions contained in the Park Rules may result in denial of access to the Park, temporarily or otherwise.
- Failure to comply with one or more of the provisions in the Park Regulations to which a Penalty Amount is not explicitly linked may result in the imposition by the Lessor of a Penalty to be reasonably determined, without prejudice to the Lessor's right to claim full damages in addition to the aforementioned Penalty.
- In all cases not provided for in these Park Regulations, Lessor shall decide.
